ARTICLE 2 – OBJECT OF THE GENERAL TERMS AND CONDITIONS OF SALE
These general terms and conditions of sale apply automatically to all bookings and purchases of tickets for shows or cultural events at the L’étoile bleue theatre. These terms and conditions of sale are subject to change without prior notice. In the event of a modification, the applicable conditions are those in force at the time of full payment for the tickets or the written confirmation of the booking conditions.
Booking or purchasing a show or activity implies the customer's unreserved acceptance of these terms and conditions of sale and the establishment's internal regulations.
ARTICLE 3 – RESERVATION AND PURCHASE TERMS
Booking activities online requires sharing certain information necessary for the smooth processing of the booking, and if desired, filling in the information required to create a customer account. When these activities are chargeable, booking them also requires proceeding with payment online or at the counter.
At the start of the performance, any reserved, unpaid, and uncollected seat will be put back on sale.
ARTICLE 4 – GENERAL PROVISIONS
Cabaret-theatre L'Étoile Bleue reserves the right to increase or decrease the number of seats available for sale, as well as the applicable price at any time, and without prior notice.
The show tickets remain the property of the Cabaret-Théâtre L'étoile bleue until final and complete payment has been registered.
ARTICLE 5 – PRICES
The price of tickets and services is in euros (€), all taxes included. Fees corresponding to the electronic processing of the order and commission for payment by bank card are paid to the corresponding providers and are fully covered by the cabaret-theatre L'étoile bleue. No discounts are valid with the payment of the order.
The prices and locations of seats are displayed at the theatre box office or communicated upon request. All prices are subject to change without notice. They are only valid after confirmation by us of the requested payment.

ARTICLE 6 – TICKET COLLECTION AND PRESENTATION
Tickets purchased from the on-site box office will be given to the customer either by email or immediately.
Tickets for shows purchased online at www.cabaretletoilebleue.fr will be sent by email to the email address provided by the customer when creating their account, and after validation of said account. They must be printed or presented on screen for inspection at the ticket office.
Ticket purchases made through the online sales site are closed 90 minutes before the start of the event. The buyer is informed, in real time, when placing their order, about the availability of the desired seats.
Regarding tickets printed by the buyer, the information on the ticket and the barcode must be clearly legible. Illegible, damaged, soiled, or incompletely printed tickets will not be accepted and will be deemed invalid.
The buyer must also ensure that information is displayed correctly and is legible on their mobile phone.
Tickets for performances purchased by telephone must be collected from the box office of the Cabaret-Theatre L'étoile bleue on the evening of the performance, upon presentation of a form of identification and proof of concession, if applicable.
Printable tickets are provided with a unique barcode. The validity of tickets is checked and recorded upon entry using barcode readers. It is impossible to gain entry multiple times with the same ticket. It is forbidden to reproduce, duplicate or counterfeit the ticket in any way, or to make it available for such purposes. A ticket is only valid for the event it grants access to. This information is mentioned on the ticket: the name of the show, the venue of the event, the date of the event, the time of the event.
Le Cabaret-Théâtre L'étoile bleue reserves the right to refuse entry to the event when several impressions, reproductions, copies or imitations of a printable ticket are in circulation and that access to the event has already been granted to a holder of an impression of the printable ticket.
If a holder of a printable ticket is denied entry for this reason at an access control point, there is no entitlement to a refund of the purchase price, under any circumstances.
ARTICLE 7 – CANCELLATION AND REFUND
In accordance with Article L 121-20-4 of the Consumer Code, tickets for shows, season tickets for shows broadcast or produced by the Cabaret-theatre L’étoile bleue are not subject to a right of withdrawal. Show tickets are neither taken back nor exchanged, even in case of loss or theft, except in case of cancellation or postponement of a show. No duplicate tickets will be issued, including in case of loss or theft.
ARTICLE 8 – FORCE MAJEURE
Neither party shall be held liable for non-performance or
delay in the performance of one of its obligations described in these GTC results from a case of force majeure. As such, force majeure means any external, unforeseeable, and irresistible event within the meaning of Article 1148 of the Civil Code and the definition adopted by French case law.
In this sense, force majeure refers to an event that the Seller cannot
reasonably have control over, including but not limited to a health crisis such as Covid-19, a strike, an embargo, tool failure, a riot, a war, a natural disaster, a fire, etc. or similar events such as adverse weather, supply difficulties, accidental production stoppages, unpredictable market changes, etc. By express agreement, a
A force majeure event shall under no circumstances prevent the timely payment of the agreed price.
The party invoking force majeure is required to inform the other party in writing within
reasonable notice by registered letter with acknowledgement of receipt of the occurrence of the cessation of the event or circumstance qualifying as force majeure. In the event of such events occurring, the parties shall endeavour in good faith to take all reasonably possible measures to continue the performance of the service.
ARTICLE 9 - PERFORMANCE TIMES AND VENUES
Unless otherwise stated, the doors will open 30 minutes before the time indicated on the tickets for evening performances. When your ticket is checked, you may be asked to provide proof of identity, undergo a security pat-down, and leave any unauthorised items at the venue’s cloakroom. Refusal to comply with such checks will under no circumstances entitle you to a refund for tickets or services booked.
ARTICLE 10 – SECURE PAYMENT
Only the receipt of payment commits the Cabaret-Theatre L’étoile bleue to provide the tickets and services ordered. Online payment is made exclusively by bank card. The information provided when entering bank details is encrypted to protect all sensitive data during payment.
The online payment transaction is guaranteed via Seetickets. In no event will information concerning bank cards pass through the network or the server of the Cabaret-Théâtre L'étoile bleue.
ARTICLE 11 – PERSONAL DATA
Le Cabaret-Théâtre L’étoile bleue may process your personal information to provide you with the requested service(s). This collection is done via a series of forms completed directly by you. This information and data are necessary for the management of any order and for customer relations. Personal data collected as part of the services offered on Seetickets are processed according to secure protocols.
In accordance with law n°2018-493 of 20 June 2018 on the protection of personal data, Cabaret-Theatre L'étoile bleue informs you that concerning your reservations
line, you benefit from a right of access and rectification, a right to object for legitimate reasons, a right to erasure and to the restriction of your personal data, or even the right to define directives concerning the fate of your personal data after your death, as well as a right to retrieve your data and a right to their portability in the cases provided for by law.

ARTICLE 12 – RESPONSIBILITIES
Transactions must be checked by the customer before their online payment. Subsequent claims cannot be considered. The Cabaret-Theatre L’étoile bleue disclaims any responsibility in the event of the purchase of counterfeit tickets and cannot, under any circumstances, be held liable for the said sale.
The responsibility for verification rests with the client.
Cabaret-Theatre L'étoile bleue declines all responsibility for damages of any nature which may affect items, objects or materials brought by spectators, when these are not deposited in the cloakroom. Spectators are responsible for any damage, direct or indirect, which they may cause during their attendance at Cabaret-Theatre L'étoile bleue.
Any recording of the performance, in any form, including photographic or digital, is strictly prohibited.

ARTICLE 14 – APPLICABLE LAW – DISPUTES
The sales referred to herein are subject to French law. In the event of a dispute, the courts of Marseille shall have exclusive jurisdiction.
Once the curtain rises, entry to the venue is prohibited. Latecomers are not guaranteed reserved seating and will only be admitted to the auditorium during an interval. Minors are permitted provided they are accompanied by an adult. Cabaret-théâtre L'Étoile Bleue reserves the right to request identification to verify the age of any person wishing to order alcohol; no alcoholic beverages may be served or ordered by a minor.
In the event of a breach of the primary rules of good conduct and propriety, Management reserves the right to intervene and to exclude any individuals acting improperly, as well as to charge for any damage caused. Grievances and criticisms concerning the show and/or performances delivered will only be considered within the context of future service improvements and will not entitle participants to any refund or compensation. L'Étoile Bleue disclaims all responsibility for damage, of any nature whatsoever, which may affect items, objects or equipment brought by spectators and which have not been deposited in the facilities provided for this purpose. Handbags and valuables are not permitted in the changing room area and must remain the responsibility of their owner. Spectators are responsible for any direct or indirect damage they may cause during their visit; in the event of an accident, the responsibility of Cabaret-théâtre L'Étoile Bleue cannot be engaged.
The L'Étoile Bleue cabaret-theatre makes every effort to ensure the smooth running of its services for its clients. However, it cannot be held responsible for fortuitous events, cases of force majeure, or the actions of third parties. In such circumstances, the L'Étoile Bleue cabaret-theatre will endeavour to find suitable solutions to overcome the difficulties encountered; and undertakes to refund the full amount of the service if no agreement can be reached.
This contract shall be governed by French law. It shall be applied and interpreted in accordance with this law. In the event of a dispute, an amicable settlement shall be preferred, failing which the matter shall be brought before the competent French courts.

L'Étoile Bleue is committed to informing ticket holders as soon as possible in the event of a cancellation due to the venue closing because of the current conditions. The rules in force regarding barrier gestures and mask-wearing must be respected within the Theatre, in order to work towards the respect and integrity of everyone. The management of the Cabaret-theatre L'Étoile Bleue certifies that it respects the disinfection needs related to sanitary conditions and commits to respecting the prevailing processes.
